The Prosecution General gave the first details about the arrest of the
Bank of Albania Governor, Ardian Fullani, and of the Chief Inspector of
this institution, Elivar Golemi.
The Chief of the Cabinet at the Prosecution General, Fjorida Ballauri, explained for the media that the Court has ordered the arrest after a request of the Tirana Prosecution.
Baullari says that after the investigation, the Prosecution has found that the Governor and the Chief Inspector have acted against the law by neglecting with the auditing measures.
“The court gave the measure of prison for Ardian Fullani and Elivar Golemi over power abuse charges. The Prosecution reached the conclusion that due to their failure to act, the two officials have created the conditions for the realization of this theft”, declared the Chief of the Cabinet at the Prosecution General.
The investigations showed that Fullani violated the law by:
1-Not proposing the second Deputy Governor to the Supervisory Council, who could have realized the financial administration and supervision;
2- Did not undertake legal initiatives for the welfare of the Bank of Albania;
3-Did not allow the functioning of the Emission Department;
4-As General Director of the Bank of Albania, he did not take the necessary measures for implementing the decisions and regulations of the Supervisory Council for the administrative work and governing of the Bank of Albania;
5-The Governor has appointed twice the same person by going against the regulation.
For Mrs.Elivar Golemi, the Prosecution has found that:
1-She didn’t make the audit based on the law and regulations of the Bank of Albania;
2-Acted against the law for the inspection and administering of the Bank of Albania finances;
3-Did not inform the Supervisory Council about the financial operations; did not make audits in 2012, 2013 and 2014, when the theft was carried out;
4-Did not complete her duties, because she did not compile any record for the vault.
