“Xhakja”, Tabaku once again absent at the HCJ

The High Council of Justice postponed the reviewing of the Ministry of
Justice request for the disciplinary measures against Judge Neritan
Tabaku. The cause for this postponement was the absence of Judge Tabaku
himself, who presented a medical report that justifies his absence in
the meeting led by the Albanian President, Bujar Nishani.

If Tabaku will be again absent for the next week, it was decided that he must bring his lawyer or representative.

“Mr.Tabaku brought another medical report and he will not be present. The first report was brought on November 5th, for 14 days. Now it is for other 15 days. I propose that the next meeting should be held on Friday 11:00”, President Nishani declared. The Minister of Justice, Eduard Halimi, asked that he should be relieved from duty for power abuse.

Tabaku was questioned a few days ago by the Tirana Prosecution, where he appeared with a cervical collar, saying that he had health problems recently. Initially he was ready to answer to the Prosecution, but then demanded to return another day. Tabaku was suspended for allegedly delaying intentionally the filing of the verdict that released Ilir Xhakja from prison, who then executed the Chief of Shijak Police, Adem Tahiraj. Xhakja was released by Supreme Court verdict that changed the result of the previous two verdicts coming from the Court of Serious Crimes, which left Xhakja in prison for 21 years, for the premeditated murder of Qerim Maloku. It was returned at the Durres Court for a review, where Judge Neritan Tabaku found him innocent. The Prosecution appealed the verdict immediately, but Tabaku failed to file the explanatory arguments for 19 months, leaving Xhakja free in the meanwhile.

Today’s meeting of the HCJ discussed about the organization and functionality of the Administrative Court and the appointment of judges from this court. President Bujar Nishani, also HCJ chairman, reiterated the significance of choosing the right judge panel, guaranteeing that this process would be completely transparent. After the discussions, the Council decided that the test for the Judge who would want to be part of the Administrative court at the First Degree and Court of Appeal will be held on 21-22 January 2013.
