Supreme Court candidates

Monday 13:00 was the last deadline of the Presidency for accepting
applications for the two vacancies at the Supreme Court. A source at the
Albanian Presidency declared for Top Channel that until October 21st,
the candidacies are not too many, as it has happened even before.

These sources have anonymously declared that there are less than 10 candidates, with some of them being:

Igli Toska, former Minister of Interior until 2005, and also member of the Central Election Commission, and former judge. Since 2005, Toska has not been involved in politics but has worked as a lawyer. During the last eight years he has continued specializations in the United States of America for war against organized crime, and also in the Marshall Center of Germany for security and terrorism issues.

Çlirim Gjata, former member of the Central Election Commission and former judge, today Doctor of Sciences and Dean of the Justice Department in a private university.

Sinan Tafaj, president of the Blind People of Albania, a lawyer, the only one who has publicly declared his ambition.

One of the conditions is not being involved in political activities or being a member of the leading political party forums in the past seven years. This condition is fulfilled by these three candidates.

When contacted by Top Channel, the Presidency did not give the names of those who have applied. Although the Presidency doesn’t have the legal obligation to make these names public, giving their names would serve as transparency from this institution.

However, it is up to the President to decree them and up to the Parliament to vote them. The problem is if this will turn into a challenge of strength between the Parliament and the President, as it happened in the past legislation with President Bamir Topi and the right centered majority.

This remains to be seen. But why are there two vacancies at the Supreme Court? On October 1st, a law that makes some amends at the Supreme Court enters in effect. It foresees the creation of two vacancies too.

From 17, this court will have 19 members after November 1st 2013. For this, the President’s Office has started the procedure for the candidates. The criteria are the same as for the other Supreme Court members.
