The Council for Regulation, Mandates and Immunity has convened to review the request of the Special Prosecution Against Corruption and Organized Crime (SPAK) for the granting of authorization by the Assembly for the arrest/revocation of the freedom of opposition MP Sali Berisha.
Berisha’s lawyer requests the suspension or postponement of the hearing, until a decision of the Constitutional Court, in which they filed the lawsuit.
According to him, the prosecutors want to repair the violations they committed in the first instance with this request. But the request to suspend the meeting was rejected by a vote of the members of the Council.
The session is chaired by the speaker of the Assembly, Lindita Nikolla, while Ermonela Felaj, Klotilda Bushka, Bledi Çuçi, Enkelejd Alibeaj, special prosecutor Arben Kraja and lawyers Sokol Mêngjesi and Genc Gjokutaj are present.
Berisha himself decided not to go to the Council of Mandates, but to be represented by lawyers Genc Gjokutaj and Sokol Mengjesi. While a decision is expected to be made for Berisha, dozens of his supporters gathered in front of the Presidency, along with the former prime ministër himself, opposing the request of the SPAK prosecution.
In the letter addressed to the Assembly, on December 12, SPAK argues that the former prime minister did not implement the court’s decision by never appearing before the judicial police officer/investigator, following accusations regarding the issue of privatization of the premises of the former Partizani sports club.
Also, the lawsuit states that the measures taken by SPAK for Berisha, in relation to the Partizani affair, should be declared incompatible with the Constitution, since authorization from the Assembly was not obtained earlier.
