Scandal, murder suspect was set free

The chrome businessman, Gjin Nika, was killed two weeks after he was set
free. Nika left prison although he was the main suspect of the
Prosecution for two murders, which raises several doubts on the
functionality of the Albanian justice.

Are suspects of serious crimes arrested with the sufficient evidence? Or do authorities look for evidence only after they take them under custody? Data show that Gjin Nika has been accused by the police and Prosecution for two murders, that of Qerim Marku and Hasan Talje, both chrome businessmen in Bulqiza.

But Gjin Nika has not been arrested for these crimes. Nika was arrested in Tirana while the investigations were undergoing. While police declare that he is the killer of Talja, the 36-year-old is taken in custody to serve the three-months prison sentence over forgery charges.

Documents show how differently is the same case seen by two courts, that of the First Instance and that of the Appeal, although the evidence is the same. While the 36-year-old serves prison for forgery, the Prosecution asks a security measure at court for another crime, the attempted murder of a citizen who claims he was almost killed one year ago, but didn’t report the crime.

The Court of First Instance say that Gentian Kaci didn’t report the crime one year ago, because he feared Nika’s connection with the Police, the Prosecution and Court in Bulqize. But this statement is rejected by judges Fatmira Hajdari, Edmond Gogo and Gramoz Levanaj, who say that this declaration cannot be considered evidence, since there is no prosecution or court in Bulqize. They say that the police in this area is organized in a directory in Diber, while the murder attempt took place in Tirana.

By changing the arrest measure from prison to obligatory appearance, the Court of Appeal judges say that the Prosecution did not clarify why the victim did not report the crime on time. The Court of Appeal judges say that the collection of evidence in these conditions would create very dangerous precedents.

After this decision, Gjin Nika stayed in prison until March 20th for falsification. He was killed 14 days after he was set free.
