While plenty of accusations against the judiciary have been launched
recently, the Minister of Justice, Nasip Naco, told during a meeting
with the Prosecutor General about the ways how to fight corruption.
During the presentation of the Council of Ministers recommendations to the Prosecution, the Minister of Justice underlined the need for active investigation.
“Pro-active investigations are required as a pre-condition for the continuity of effective criminal prosecution in all levels, especially in the areas where there is a strong public perception for corruption. For reinforcing the fight against corruption we recommend: increasing the number of investigated cases, especially of pro-active investigations for mid and high levels of the state administration, the judiciary system and of officials without immunity; reinforcing the inter-institutional coordination in police services for exchanging information and for an effective use of the special investigation methods; for guaranteeing evidence and hitting corruption; quick efficient investigation and a rigorous implementation of the criminal procedural dispositions; application of the security measure for corruption cases and hiding wealth, product of a criminal act”, Naco declared.
While the Procedure Code amends consider corruption as a serious crime, the General Prosecutor, Adriatic Llalla, declared that the Prosecution of Serious Crimes is in a phase of reorganization because of this.
“This is for what is considered as very important in reinforcing investigations, by asking efficiency and speed in completing the investigative actions. Most of you have noticed that the duties have been fulfilled correctly, but there are cases when it is not satisfactory”, Llalla declared.
Minister Naco replied to the Resolution of the Judiciary Conference, in which it has been concluded that the Ministry of Justice should take measures for not publishing the cases reported by the public without having them verified first by inspectors.
“The Court will know how to orientate judges for the accusation. The accusations are not made by the Ministry of Justice. The Ministry wants every institution to report corruption wherever it is seen, and I believe that those who raise this matter with force feel trapped from the huge pressure they feel. If you refer to the President, who says that Judges don’t think how to start their day of work, but how to receive the envelope from the lawyer, Prosecutor or others, I believe that the situation is very serious, since it is said by the President himself”, Naco declared.
This April, based on the case of a judge who was reported at the Ministry of Justice website, the Commissioner for protection of personal rights asked the Ministry to remove the personal data of this judge from the website “report corruption”. For the same case, the Court of Durres has ordered that the complaint of the citizen should not stay public, since it damages her reputation and image.
