Prosecution requested an arrest warrant for Sali Berisha to the Assembly: He has not implemented the Court’s decision

On Monday, the Council of Mandates meets to review the request of the Special Prosecution Against Corruption and Organized Crime for the granting of authorization by the Assembly for the arrest of MP Sali Berisha.

This falls on the same of the appearance of the former prime minister Berisha before the judicial officer, a decision which he has refused three times.

In the letter addressed to the Assembly, SPAK argues that the former prime minister did not implement the court’s decision by never appearing before the judicial police officer.

Disagreeing with the above two decisions, the person under investigation and his defenders filed an appeal.

The Special Prosecutor’s Office adds that the law clearly states that when security needs are aggravated, the prosecutor can ask the Assembly for authorization to replace the security measure with another more severe measure.

During a press conference, when asked about SPAK’s request to change the security measure, Berisha said that he respects the Assembly’s decision. The former prime minister emphasized that “by opposing the court’s decision on the non-implementation of the ‘mandatory appearance’ measure, I defended the parliament”.

A day ago, the journalist Anila Hoxha reported that the claim of former Prime Minister Sali Berisha, that the SPAK prosecution should receive authorization from the Assembly for the security measure, is not based on evidence.
