Prosecution appeals Gjoni’s verdict

The Prosecution has appealed the decision of the Elbasan Court, which
rejected the request for suspending judge Gjin Gjoni, with the same
argument that they used before, which is that Gjoni might put the
evidence in danger.

Prosecutors insisted in Gjoni’s suspension, since the Court of Elbasan did not mention all the circumstances, and did not analyze them righteously before giving the security measures.

The Prosecutors say that the courts admits that there is a repetition of the mentioning, and that the asset hiding act has been consumed, which means that the court admits that they suspect that the person in charge has consumed the criminal act.

The Appeal says that the court is wrong when they say that the Prosecution has not made any other investigation, and have provided only the report taken from the High Inspectorate of Declaration and Audit of Assets. The Prosecution says that the report itself has a series of acts taken from the High Inspectorate of Declaration and Audit of Assets, while the Prosecutors have given to the court the acts seized from the notaries that are being investigated.

The court’s argument that the person under investigation is member of the HCJ, and for this he cannot be suspended as a judge, is not necessary, because the Prosecution wants his suspension as Judge, not as member of the HCJ.

They also oppose the court’s argument which says the acts for which Gjin Gjoni is being investigated are prescribed. The Prosecution says that the criminal acts were committed in cooperation, and this is not prescribed.
