Albania’s representative in the NATO, Rear Admiral Kristaq Gerveni, will not have the hand over his duty and return home.
The Administrative Court decision ruled in favor of his request and suspended the order of the Minister of Defense.
This decision will stay in act until the trial will be over. Gerveni asked the judiciary to repeal the administrative act of the Defense Minister that orders him to hand over the duty and return home.
Judge Aferdita Maho says that there is reasonable doubt that there might be damages for Gerveni, based on documents.
The Court states that no public interest is damaged in this case, since no vacancy is created in Gerveni’s job as military representative at the NATO, and as representative of Albania’s interests.
According to the Administrative Court, this decision enters in effect and parties may challenge it at the Administrative Court of Appeal in Tirana.
