The Albanian President returned another law brought by the majority. The
head of the Albanian state did not decree the law amends for the
functionality of the High Inspectorate of Declaration and Audit of
Assets and Conflict of Interests.
The President does not agree with the fact that the Director of the High Inspectorate of Declaration and Audit of Assets is not elected by the President, but undergoes another procedure through the selection and approval of candidacies by the Parliament.
The President says that this amend goes against the Constitution. Although he confirms that the propositions for the candidates of the High Inspectorate of Declaration and Audit of Assets are not written on article 92 of the Constitution, which foresees the other competences of the Head of State, the president refers to article 94, which, according to him, clearly states the purpose of the constitutionalists for giving the lawmaker flexibility in defining other competences for the President, says Nishani, who says that the amends are politically biased.
“Removing the President’s competence to propose the candidacies for the selection of the Director of the High Inspectorate of Declaration and Audit of Assets and Conflict of Interest, is an institutional accusation that is made to the President, as Constitutional organ, for a political partiality, by going against the Constitutional provisions and his functionality as Head of State”.
The President adds that this minimizes the independence of the Inspectorate, if he is appointed only frm the Parliament. The arguments used by the President are what the opposition declared in Parliament, when the law amends were passed.
