President decrees only resignation of Ministers, PM introduces new Minister

There are two Presidential decrees in Parliament for the resignations of
Ministers Shkelqim Cani and Arben Ahmetaj. However, they will not be
voted.  The news was confirmed for Top Channel by official sources
within the majority, which is waiting for two other decrees from the
President, those for appointing Arben Ahmetaj and Milva Ekonomi
respectively as Minister of Finances and Minister of Economy.

Chances are these decrees will not arrive within the constitutional 7-day deadline. Official sources from the Presidency confirmed for Top Channel that Bujar Nishani has decided to not decree the two Ministers before the Parliament reviews the two resignation decrees.

If the parties stand to these positions, the institutional crisis between the President and the Prime Minister might soon turn into a constitutional crisis that might require an interpretation from the Constitutional Court. In this case, the government might file a complaint, if the President has the right to not issue the decrees of appointing the Ministers before the Parliament reviews the decrees of discharging them.

Ilir Rusmali, former Minister of Justice during the Berisha government, and former Chairman of the Commission of Laws, said for Top Channel that in every Parliamentary Republic, the will comes from the Prime Minister, and this will is certified by the Parliament. The President has only seven day to finalize the decrees.

President Nishani has proved several times to be able to issue the resignation decrees on the same day with the appointing decrees. However, PM Edi Rama did not lose time and found a way to introduce Ahmetaj as the Minister of Finances in a meeting with international donators.

TCH: Will there be a constitutional crisis since the President has not decreed the Ministers?

Kryeministri Rama: There is no problem. The Ministers continue their work.

TCH: Have you discussed with the President about the decrees?

Kryeministri Rama: There is no need. The President discusses it with the Constitution, the Constitution with the President and then comes the decree.

TCH: If they do not agree?

PM Rama: I never give a declaration with “if-s”.
