The Albanian President, Bujar Nishani, challenged the law amends for the High Council of Justice at the Constitutional Court.
The President is trying to repeal article seven, which is the main point of this amendment, and which is related with the selection procedure of the Vice Chairman of the HCJ.
According to the President, the implementation of this law would deprive the HCJ members of the right to appoint the judges who will be proposed for this process.
The President says that the only purpose of this, is to capture the justice system. The request sent to the Constitutional Court says that the independence and rights of this institution are severely damaged, by damaging also the constitutional and international standards.
The request underlines the fact that the Parliament has started a procedure for discharging two members of the HCJ, to replace them with two others that will be selected by the majority. This confirms the illegal intervention, according to the President.
The President asked the Constitutional Court to address to the Commission of Venice, in order to give a specialized opinion about the law in question.
Based on these arguments, the President asked the Constitutional Court to repeal these amends and to suspend the law dispositions until the Verdict of the Constitutional Court enters in effect.
