President about to receive Vetting Law. Judges who resign will not be vetted

The vetting law, passed by the Parliament in an extraordinary session,
was taken this Thursday to the President, who has the legal power to
express himself within 20 days.

President Bujar Nishani has three choices: to not express anything at all about the vetting law, which means that after the deadline expires, the law immediately be posted on the official bulletin.

The other option is to oppose it by returning it to the Parliament, which would make politicians gather and pass it again.

The third option is to approve the vetting, which would require 15 other days until it enters in effect.

After this, the vetting law will be followed by other deadlines decided by the justice representatives.

800 judges, Prosecutors and assistants will fill four applications. Within 30 days, these applications that allow monitoring of communication and finances, and audit declarations, will be handed over to a commission that needs to be established and that enjoy a special support by the state.

Judges and prosecutors of the entire system will be forced to declare wealth of family members, and if they have had contacts with people from the crime world.

They are asked if they have accepted money and gits from criminals, and if they know other people who do.

The other wealth declaration application foresees that in case of fake declaration of assets, the applicants are discharged.

The law states that the applications are then sent to the commission that requires the same deadlines for the selection. Within 60 days, the High Inspectorate of Declaration and Audit of Assets, and DSIK, will answer to the commission for these applications. This means that by the beginning of 2017, there will be an answer for those who will be punished and those who will escape the vetting law.

The law also offers the possibility to resign,  with a resignation request to the President, which makes them not go under the vetting process.

Until then, however, there will be other developments since a team of international observers will arrive in Albania within September, and will join the reevaluation procedures of judges and prosecutors. The law package will need to be approved, the most important of which is the establishment of the Special Anti-Corruption Structure.
