OSCE wanted Military Home

New facts are discovered regarding the Military Home, which will turn
into a military headquarter for the Democratic Party, after it has been
approved by President Nishani and the Council of Ministers.

The OSCE mission in Tirana has treated with the Albanian government by the end of 2011 to turn the Military Home into a building of the OSCE, and they made a concrete offer to Mr.Berisha to modernize the building and pay a thousands of Euros rent each month.

The treaties lasted for two years but resulted unsuccessful, because the government of Mr.Berisha argued that the Military Home belonged to the army and it had historic values and was included in the NATO plans.

Top Channel asked the OSCE office about this matter but there has been no answer yet. Meanwhile, Prime Minister Berisha declared yesterday: “Truth is that the Military Home has lost every function in the last 12 years and has turned in a house of weddings and funerals, and this is evident for everyone who has passed there”, he declared.

The legal basis of the decree

Regardless of the decision taken by the Council of Ministers, there is another important and undiscovered fact about this issue. The President’s decree as General Commander of the Armed Forces removed the Military Home from the inventory of the army, although the Chief of Staff, General Gjunkshi, was completely against it.

The decree has arrived at the Ministry of Defense this Thursday but has not been published yet, as it usually happens on the official website of the Presidency.

Constitutionalists are waiting to see the legal basis of the president in this decree, and they confirm that if the legal basis will not bring a strong legal argument, there is the need for interpreting it from the Constitutional Court, if it will be sent to Court.
