No immunity for any official

Besides the electoral reform, the removal of immunity in high rank
officials is one of the recommendations that Albania must fulfill for
receiving the candidate status.

Both parties have publicly declared that they are ready for this initiative, but only now they have started working concretely. The Democratic Party MPs and their allies submitted to the Albanian Parliament the initiative for changing the Constitution and removing the immunities.

The draft has 5 articles and the initiators say that they have adapted in Albanian a material that was approved by the Socialists too. It is the EURALIUS document, the EU Mission for justice and also PACE, the project of the Council of Europe for war against corruption. These two projects that have been publicly discussed on October 2011, remove the immunity from the Prime Minister, the Ministers, the MPs, the members of the Constitutional Court, all judges, the Ombudsman, the chairman of the Supreme State Audition.

Currently, no MP or Minister can be prosecuted without having the Parliament authorizing it. According to the proposition of the majority, this law is repealed according to the majority’s proposition. The MPs and Ministers have only one defense. They can have their immunity returned if the actions of a given MP are damaging the Parliament’s functionality.

With the initiative of the majority, the immunity has been removed for all judges that used to have protection from prosecution by higher institutions or the Constitutional Court itself.

The Parliamentary Group leader for the Democratic Party, Astrit Patozi, believes that the discussion for this initiative starts next week, so that it can pass through a plenary session before this Parliamentary season is closed. For this reason, the Democratic Party invites the Socialists to join the initiative and fulfill one of the obligations of the European integration for Albania.
