One day after the Parliament rejected the two candidatures for the
Supreme Court, the Albanian President, Bujar Nishani, reacted through a
critical declaration against the ruling majority.
The declaration says that the reason brought by the Commission of Laws, according to which the two candidates didn’t fulfill the condition for having the specific formation in the administrative law is a simplified reasoning and unfounded.
“What happened with the voting shows that the political consensus between the parties, after the request of the European Union for the new Law of the Supreme Court, did not pass the test. What is seen clearly is that the refusal was made through a procedural trick. We are talking about the President from one side, and for the ruling majority on the other, which has political tools. This is a very wrong approach”, Nishani declared.
The President insists that by the conclusion of this important process, with the decreeing of Petrit Ceno and Gjovalin Pernaca, he has respected all legal criteria.
“With regret, the President notes that the decision for rejecting the candidacies is maybe a directive, suggestion or even order for planning a relation that suggests to the ruling party to reject this decree. Conflicts are not born on their own. They have an origin. They start small and turn into unstoppable avalanches, mostly due to the failure to respect the procedures. This brings a very high cost not only for those who degrade the procedures, but for everyone. The voting of the ruling party and the position held by them regarding all institutional procedures leaves much to be desired, and it shouldn’t be overlooked as nothing happened”, the declaration says.
The President explains that it is in favor of the general interest of our country and the Albanian citizens that these decisions, which are based in the inter-institutional loyalty, should not be damaged by the interests of political groups.
