The Albanian President, Bujar Nishani, declared in the High Council of
Justice that this institution has nothing to do with the political
majorities.
By requesting independence of the HCJ, Nishani declared that this council brought the model of appointing judges only based on their merits.
“This is for respecting the existence and function of independent, uninfluenced and unintimidated institutions; for offering you knowledge as experts of this area, and for the great responsibility that you have to the public opinion and Albanian citizens. This responsibility grows each day so that we can establish standards that will be irreversible in the future”, Nishani declared.
While speaking about a model evaluation process, some of the judges that were appointed at the Tirana Court of Appeal are among the most controversial for serving to politicians.
Marie Qiriazi was Judge of the Electoral College and was accused by the opposition for taking unilateral decisions regarding the local elections of May 2011. Ridvan Hado and Fatmira Hajdari have been under the media attention for the Gerdec Trial, while Agim Bendo is the most controversial one, not only for his decisions based on nepotism and politics, but also for the famous 400.000 EUR fine against “Fiks Fare” over the “Pango” case, when the former Minister of Tourism and Culture was filmed trying to seduce and take sexual advantages from a young woman in exchange of a job at his Ministry. HCJ has also appointed one of their members, Ilir Mustafaj. The two other names that passed were Shkelqim Mustafa, Civil Court judge, who gave arrest measures for the January 21st National Guard soldiers, although they were liberated in appeal; and Ervin Metall, Head of the Durres Court.
