Naco, the HCJ is not being captured

“The discharging of two members at the High Council of Justice is not a
capture of this institution”, declared the Minister of Justice, Nasip
Naco, to oppose the accusations of the opposition. His argument was that
this will not change the majority of the HCJ.

“10 of the 15 members at the HCJ come from the Judiciary Conference, that’s why the appointing of two new members will not change anything. The initiative for replacing them comes after one year of constant violations, among which was the failure to take in the daily agenda the proposition of the Minister of Justice, and also the recent case of the law amends for the functionality of the HC”, Naco declared.

“They don’t want reforms and keep repeating the same stances, without wanting the situation at the HCJ and at the judiciary to change. The two members appointed by the Parliament have moral, legal and individual responsibility. There are procedures in which Mr.Cefa has led the session delegated by the President, and the voting is individual, not collegial. He has never supported the Minister of Justice and his requests”, Naco declared.

Admitting that the HCJ has deeper problems that just these two members, Naco declared that what they are trying to correct in this case is replacing the institutional balances of the HCJ formula.

“This is more about the spirit that was brought at the HCJ, than about calculating votes. Certainly that there is room for intervention, after the stance these people have held”, Naco declared.

Naco said that despite this initiative, the judiciary reform will be deep and it will start with the conference warned on October 6th.

“The reform that we are demanding will be deep. I believe that it will affect the HCJ, the National Judiciary Conference, the Supreme Court, the Constitutional Court and the Prosecution General. Certainly that the conference will be discussed and everyone will be able to share opinions”, Naco declared.

If the majority demands a deeper judiciary reform, why do they start it by discharging the two HCJ members?

“We have done nothing more, but we are keeping the HCJ on the right track. The next reform will be done together with the international partners and local actors”, Naco underlined.
