A day after the public disclosure of the Metrology Directorate for detection of 14 subjects involved in trade of fuel, which deceived consumers by stealing the amount of fuel sold, the Prosecution of Tirana has formally asked the institution to file legal charges on these subjects.
But even two weeks from that day, Metrology Department has not filed any charges.
Resources in the prosecution of Tirana, declared for Top Channel that the unit of Task Force will launch investigations mainly to commercial entities for tax evasion, fraud and theft. And, if there will be evidence for these allegations, then the executives Metrology will be accused for crime concealing.
According to prosecutors, the institution has the legal duty that, in cases of market fraud, besides the administrative penalty shall also submit for prosecution charges against subjects who cheat, commit tax evasion or steal the customer.
Metrology Directorate stated that they could not make public the names of commercial entities that deceive consumers, because according to interpretation of the law, it is violation of privacy and business interests. But this institution has not stated the names even for the prosecution, which is its legal task, limiting to the imposition of modest fines, something that opens the way to Prosecution to press charges also on the leaders of this institution.
Metrology: we will not publish the names
General Directorate of Metrology insists that legislation forbids the publication of names of entities that cheat on the amount of fuel they sell to consumers.
A day after the Deputy Minister of Economy Eno Bozdo stated that this institution has the duty to inform citizens in a transparent manner on the findings in the stations inspected General Director of Metrology Kozeta Mesiti says that inspection law in the Republic of Albania does not allow the publication of data relating to the business activity of subjects.
“Information according the principle defined in paragraph 1 of this Article shall be based within the limits of the law and the protection of personal data and data relating to commercial or professional activity of the subject of inspection or other persons. On this interpretation point, we have no right to publish, because we are obliged to protect the interests of consumers, as well to protect the business interests,” said Mesiti.
Mrs. Mesiti says that Metrology Department has compiled the Normative Act, which clarifies the position of the Directorate for the publication of these subjects and is ready to implement it at the moment that it will be approved.
“We are open to publish the names of all the subjects who have problems, but of course in support of the fulfillment of this normative act that is much needed. We will publish them by issuing commercial data related to subjects”, said Mesiti.
The director of Metrology says that 14 subjects who abuse with the amount of fuel are not denounced to the prosecution as they are classified as administrative violations.
“We have considered all the cases as administrative offense and we don’t see any elements of offense. At the moment we are dealing only with administrative violations,” said Mesiti.
