While having difficulties to seize properties, as a right that derives
from court or administrative orders, the government has asked the help
of private bailiff companies.
The decision was taken in yesterday’s meeting of the Council of Ministers and consists of the review for the Prime Minister’s Decision, approved in July 2010.
The law “for preventing and eliminating illegal traffic and the organized crime through preventive measures against assets” and the law “for the organization and functioning of the service of the judicial bailiff”.
According to “Shqip”, the decision says that the procedure of handing the revoked assets to the owner is made according the procedures of the Code of Civil Procedures, followed by respective documentation, which the judicial bailiff takes from the assets administration.
In the case when the assets are not taken by the owner, after a period of 30 days after the notice for the act of revoking the seized assets, the agency asks the Court that has issued the order to remove the seized asset from its administration”.
The agency is excluded from the preliminary payment for executing the seizing decision, while the fees assigned in this decision will be applied even for payments of bailiff services, which have not been performed by the agency until the moment this decision enters in act”.
