Kosovo, Constitutional Court announces verdict

Constitutional Court of Kosovo announced the verdict that considers Behgjet Pacolli’s Presidential election as unconstitutional.

But this Court gave no clear recommendations on what further actions must be taken for Kosovo’s new Head of State.

“The Constitutional Court, during the session held on 2011March 28th, has unanimously decided, with seven votes pro and one con, that Kosovo’s Parliament decision regarding the election of Kosovo’s President on February 22nd 2011 is unconstitutional”, says the verdict.

The Constitutional Court found an infringement on the election procedure, which, according to the Court, needs more than a candidate. Quoting the Constitution, this Court notes that this procedure shouldn’t have been undertaken without the appropriate deputy presence on the Parliament Floor.

The Constitutional Court also considers the opposition’s boycott as an infringement to the law.

On this verdict, the Constitutional Court confirms that there are problems with Article no. 86 on the Constitution of Kosovo, regarding the election of the President and recommends a review.

Meanwhile, Mr. Pacolli’s adviser, Ibrahim Gashi, says that Kosovo’s Head of the State is ready to fully respect the Constitutional Court’s decision and that he will remain the presidential candidate of the “New Kosovo Alliance’s Party”.
