Justice surrenders to lawyers

The trial against Dritan Dajti was postponed again, while there is no
way how to unblock this trial, despite the public appeal of the
President of Serious Crimes, Sander Simoni, to the Chamber of Lawyers
for taking measures against lawyers.

Referring to the multiple appeals of the Court of Serious Crimes and the Ministry of Justice about this case, but also for other cases in which the lawyers delay the processes by not being presented at court, the Director of Justice Matters, Marsida Xhaferrllari, declared for Top Channel that they asked information from the Chamber of Lawyers, but the Ministry cannot intervene due to law limitations.

Mrs. Xhaferrllari declared that all parties should be heard, while the Ministry took measures for changing the law about lawyers.

“If there are infringements from a lawyer, discipline measures will be taken, but there are several ways for this situation, because the lawyer must take maximal care to save his client. The lawyer must receive the message that the judge is committed for an efficient process by presenting the legal evidence. But there are cases when the most extreme measure is taken, a disciplinary procedure”, Xhaferrllari declared.

Top Channel tried to receive a reaction from the Chamber of Lawyers, but there was complete indifference. The Head of the Penal Lawyers Association, Saimir Vishaj, declared that each time that the processes fail, lawyers are to blame, while they are the ones that are paid less.

“A 15 days delay foresees a discipline procedure. It’s not the lawyer to blame, but the judge”, Vishaj declared.

In a previous interview for Top Channel, the President of Serious Crimes Court, Sander Simoni, declared that if there will be no reaction from the Chamber of Lawyers, this court will expel some of them from the list.

Although the lawyers are the authors of the most important delays, no license has been revoked, while the fines are ridiculous for the budget of the law firms that are defending the Albanian crime bosses.
