Judges: Don’t publish investigations against us

The frequent accusations against judges and the judiciary in total has
caused a reaction from the Union of Judges, who want confidentiality for
the verification or investigation of cases against them, and for not
publishing their complaints.

The Union of Judges brings in attention the essential principles of the UN over the judiciary independence.

“An accusation or complaint made to a judge in the professional and judiciary capactiy should be reviewed quickly and with justice, based on an adequate procedure. The judge should have the right of a hearing. The preliminary investigations need to be confidential, unless the judge wants it differently”, the principles declared.

As refers to the publication of cases, decisions and concrete names, the Union reminds the recommendations of the European Council Committee of Ministers for the efficiency of justice.

“The decisions of judges should not be reviewed, except for the appeal or review proceedings as provided by law. The executive and legislative pwoers should avoid critics that undermine the independence and public’s trust on the judiciary. We should also avoid action that might show lack of will to obey to judge’s decisions, but they might declare their goal to make an appeal”, the recommendation says.

The Union of Judges says that the approach of the Union to the complaints made against judges should be based on these standards and principles, otherwise it damages the independence of the judiciary and the public’s trust on justice.
