Judge objects high judicial fees

Encouraged by the lawsuit of a Pogradec Municipality fired employee,
which should pay a priori the 3% of the suit cost, according to the fees
set two years ago, the judge of this file addressed to the
Constitutional Court for objecting the expensive judicial fees that
create unequal access of the people to the Court.

The unemployed woman should deposit a quantity of money before suing the municipality. Judge Klodian Rado suspended the case and addressed to the Constitutional Court, to which he asks the repeal of article 9975 of 28 July 2008 for national taxes.

Judge Rado says that according to these laws, it is impossible for the tax and fees to be multiplied as the Ministers instruct, while the Constitution foresees other options.

A Ministry of Justice and Ministry of Finances instruction in 2009 order the judicial fees to be four times higher at the Ministry of Justice, the Prosecution, the Notary and the Real Estates.

The cost of a verification statement changed to 400 ALL, notary logalizations 800, suspension decisions 800, factual statements 800, suits for divorce 9000, and property damage suits more than 100.000, for which the citizens must pay 3% of the total sum.
