During an interview for Top Channel, the former Prosecutor General of
Albania, Ina Rama, declared that the decision of the High Council of
Justice was against the law.
Referring to President Nishani’s declarations a few months ago against her return in the judiciary, Rama declared that this position held by the President, as Chairman of the HCJ, was politically biased and expected.
“There’s no legal argument to justify the pending of my request, besides political reasons. The law clearly states that the Prosecutor General returns to the former duty as Judge of Appeal when the mandate is over, or in an equivalent duty. This issue has been suspended for one year. I have addressed to the President and the Minister of Justice, but only the Minister has included my case in the agenda”, Ina Rama declared.
When asked if our country has had justice for important cases, such as the Durres-Kukes case, Gerdec and January 21st, the former Prosecutor General declared:
“The Courts did not support us. As former Prosecutor General I must say that justice was not made. I don’t think that courts have rejected the case due to the poor performance of the Prosecution. These cases were complex, full of political charges, and the Prosecution was alone. We might have had other results with a political will. However, the court’s decision has nothing to do with the performance of the Prosecution”, Rama declared.
The former PG declared that the January 21st case remains under the competency of the Supreme Court, but for the rest, Rama agreed with the idea for a foreign expertise.
“This case is under investigation. Part of the case that is at the Prosecution might receive assistance from foreign Prosecutors. It is challenging as an idea, but maybe we need concrete help from foreign experts”, Rama declared.
