Ina Rama: Courts penalize Prosecution

The Albanian General Prosecutor, Ina Rama, spoke about some of the most sensitive cases that her justice institution is facing.

Rama blamed the judicial system, which, according to her, in the situation that we are in, has hampered the prosecution’s vigor by giving unfair sentences, especially with cases related to corruption.

As regards this involvement of high rank government officials, the General Prosecutor sent three cases to court, two for power abuse and one for corruption. In three of these cases, according to Mrs. Rama, the courts have found that the prosecution’s charges are unfounded.

“The prosecution has filed corruption cases against low and high rank officials, but the judicial system has penalized us with the war against this phenomenon by reducing the prosecution’s vigor. It is a real situation. There have been three cases for high rank officials, and in all cases the court decisions have not been in favor of the accusations that we have charged. We think that the court has been wrong in all of these three cases. This hasn’t been perceived by us as a failure, but as a different approach to the judicial system”, Rama declared.

Mrs. Rama added that the Prosecution suffers corruption too, and that the efforts to fight it are still on. As an example, the Prosecution brought the investigation of two prosecutors, although the court’s verdicts were wrong in both cases, according to Rama.

“Corruption is present even in the Prosecution. Our mechanism is legal prosecution. There have been two corruption charges against our prosecutors, and I have asked imprisonment, for not tolerating this aspect. But in both cases we haven’t been supported by the court. In one case the court found the defendant not guilty, when it was clear that he was involved”, Ina Rama declared.

January 21st

On May 23rd we held the first session for the January 21st event, where four people were killed. However, this session lasted only 10 minutes, since the prosecutors demanded more time to express the requests of the defendants’ lawyers, among whom was the National Guard Commander, Ndrea Prendi.

But in what phase is the Prosecution’s process for this case, where the state structures are included? Ina Rama declared that they have secured the necessary evidence that identify the killers of the three persons, while for one of the killings, the case has been suspended because the prosecutors were unable to identify the shooter.

“The investigations were difficult, because January 21st is a very complex case, even more than Gerdec. The investigation is difficult and the entire public has felt it. It has been in difficult conditions, maybe for the fact that in this investigation includes state structures, and this type of investigation is difficult anywhere in the world. With the help of the FBI and the US experts, we were able to make many things that we could not do without this support. We have reached identifying the authors and the killers for the three victims, and we have suspended the investigation for one of them, because we haven’t identified the shooter”, Rama declared.

As for the investigation of the three Socialist MPs who are without immunity (Taulant Balla, Besnik Bare and Saimir Tahiri) and who are to be investigated for the January 21st protest, Ina Rama declared that the investigation group is still collecting evidence.
