Immunity lifting debate

Fehmi Abdiu, former President of the Constitutional Court thinks that
immunity for MPs must be completely removed, but judges must have it
limited.

“It would be acceptable for politicians to have no immunity at all, since they are equal, as all other citizens. But judges must have it limited, since their work has some special elements and the demand the judiciary factors to support them, so that they can have their independence. I think that the judiciary must keep its immunity in a limited form, although they have showed to have weaknesses, defects and corrutpion”, Abdiu declared.

Abdiu expressed the need for a series of preliminary steps, before going to Parliament and vote the Constitutional amends.

“The Constitutional amend process that has been accepted by both parties should be transparent, all inclusive and allow the government officials, the civil society activists and experts of the area to contribute to this problem and not allow the same mistakes of 2008. All political forces must publish their official variants and give an opportunity to the entire public opinion and other actors, so that they can give their contribute and give their opinion about the propositions that were laid out, and appoint a date for this indispensable Constitutional amend”, Abdiu declared.

Besides the amends that he proposed for the immunity, Abdiu thinks that there are at least 15 other aspects that should be adapted to the new Albanian reality, and the need to approach our legislation with the European one.

“I think that the Albanians don’t resolve anything with this. The Constitution has been working for the last 15 years, but as all other previous constitutions, it has its problems. I think that the Parliament and the Albanian political actors will be obliged to return to other Constitutional amends”, Abdiu declared.
