HIDAA Chief Inspector discharged

The majority voted without the presence of the opposition and suggested
the Parliament to discharge Zana Xhuka, Chief Inspector of the
institution that audits the assets of politicians, high rank officials,
judges and prosecutors.

Two months ago, after some employees of the High Inspectorate of Declaration and Audit of Assets filed a complaint, the Commission of Laws appointed some Parliament Members to make some verifications and asking the ones who are interested, besides Zana Xhuka, who refused, according to the Socialist Party Parliament Members.

Their report speaks about several violations made by Xhuka, but the majority base their proposition for discharging her on the failure to fulfill the formal law criteria as declared president, which is a 10 year experience as economist or lawyer.

“For this reason, the Parliament declares as invalid the appointment of Zana Xhuka as Chief Inspector”, declared the Socialist Party Parliament Member, Armando Subashi.

The opposition asked the Commission of Laws to interrupt all procedures, and considered this decision as anti-constitutional. The Democrats see this as an attack of the current government against the independent institutions, to take them under their control.

The opposition filed an appeal at the Constitutional Court, since they see it as a danger for the functionality of the Democratic Institutions.

“If we will tolerate this violation of the constitution and of the entire legal base that regulates the Parliamentary audit, then the question is: what other independent institution, constitutional or not, will be executed by the Commission of Laws and these other illegal groups?”, Bylykbashi declared.

The opposition left the Commission of Laws without admitting to become part of the discussion, an action that the Socialist Party member, Fatmir Xhafa, interpreted as an effort to defend a person and not the institution. Xhafa quoted an article of the constitution to show that the majority’s action to control the action of the High Inspectorate of Declaration and Audit of Assets was based on the constitution.

“The leaders of state institutions, by request of the Parliamentary Commissions, explain and inform about several matters of their activities. This is the constitution of our country, of the majority, of the opposition and of every citizen. This is the constitution for Bylykbashi, Lulzim Basha, Zana Xhuka and everyone. No one can ever deny the verification and implementation of the law”, Xhafaj declared.

By changing the head of the Institution and Verification of Assets, the Majority will propose other changes for the functionaliy of this institution, and the criteria for choosing the next leaders.
