The inspection of the High Council of Justice concluded that there have
been infringements during the trial that granted freedom to Ilir Xhakja,
who was accused of murder and one year after he was freed he killed the
Chief of the Shijak Police.
The HCJ inspectors reported the infringements to the Minister of Justice and suggested a disciplinary proceeding against the judges that freed the killer of the Shijak Chief of Police.
The HCJ says on a press release that after verifying the public complaint against the judges at the Durres Court, regarding the Ilir Xhakja’s trial, they identified irregularities that caused disciplinary proceeding for the judges.
The declaration says that “The HCJ vice Chairman gave to the Minister of Justice the respective documentation and the report for continuing the legal procedures against the judges”.
The investigation of the Judge Panel, especially of Judge Neritan Tabaku, started four days after Top Channel reported the fact that the verdict and its explanatory arguments had been delayed beyond any legal deadline.
Tabaku had not published the arguments for more than 20 months, withholding this way the defendant’s Court of Appeal trial.
Top Channel published some documents that showed the Prosecution’s complaint over the First Degree Court, when Ilir Xhakja was found innocent for the intentional murder of Qerim Maloku.
This complaint is dated February 18th, 2011, and the appeal case had not started since then, because the Court of Appeal did not have the verdict with the arguments.
HCJ took not only the verdict given by the Judge Panel led by Neritan Tabaku, Fejzo Hysi and Ndue Gjura, but also other administrative materials for the investigation of this case.
