“HCJ has violated the law”

Prof.Dr.Agron Lamaj, a former member of the Supreme Court, had his
mandate expired five years ago. Since then he has been waiting for the
High Council of Justice to appoint him to another court, as the law
requires.

While there have been dozens of meetings during this time, Lamaj has listed three requests at the HCJ, but he has been unable to work again as a judge. During an interview for Top Channel, the former judge accuses the HCJ of failing to implement the law.

“The HCJ has violated article 26 of the law for organizing a judiciary that imposes us to get appointed to the Court of Appeal directly. I made a request in several courts, starting from Vlore, Durres and at the Court of Appeal of Tirana. No answer was given, regardless of my request”, Lamaj declared.

During this silence, he made an address to the Civilian Court.

“The return of these acts was ridiculous, because it was a claim that was not based on the law. The judge wanted from me the evidence that only HCJ had. I asked them from the HCJ vice Chairman, but he never answered. The Court returned the acts, since he did not answer”, the former judge declared.

Lamaj has returned to the academic life, while waiting to return at courts. But how does he perceive this HCJ?

“A reform is needed for the justice institutions, from the way how appointments are made and how judges are discharged. In the case in question we are dealing with the HCJ that is made by judges who return into an institution that take their colleagues in trial. This is not right. A judiciary should be independent and a judge cannot take another one in trial. The HCJ members should not be judges, but simply members and deal only with justice and law implementation”, Lamaj concluded.
