After the harsh debates that characterized the High Council of Justice
meeting this Friday, HCJ gave another signal, a press release for the
media, in which it seems that the relation with Minister Nasip Naco
could continue to be tense.
In this declaration the HCJ considers the stance of the newest HCJ member, Naco, but also of the Deputy Minister Arben Isaraj, as a move with political backgrounds. By expressing determination to consolidate the Albanian justice, HCJ underlined that they welcome suggestions for improving standards through tangible solutions, not creating artificial obstacles.
The HCJ says on its website: “The claims of the Minister of Justice that it is impossible to chose the court leaders and fulfill vacancies since the HCJ has not finished the second career assessment for the candidate judgjes, not at all realistic and with an attempt for political interferences in the justice system. The political background of this stance is being reinforced even by the declaration of the Deputy Minister of Justice, Mr.Isaraj”.
The Deputy Minister Isaraj is mentioned due to his status on Facebook, in which he says: “The HCJ has openly violated the law with the rushed and absurd argument that the HCJ is defending the judiciary which according to them is in an extreme need to be protected from the attacks and damages of judges who are commanded and not appointed by the politics that was removed through votes. The injustice at the HCJ is a threat for the judiciary everywhere in Albania. This is where the justice reform should start from”.
The HCJ replies: “The technical arguments used by them are some detached readings of the respective legal dispositions, which fall against the rule of law and its goal to have a stable leadership of courts, and to avoid the directions with unreasonable time limits. This stance also falls against the public declarations made by the Minister himself a few days ago, who criticizes the HCJ for delays in the process of appointing court leaders.
The first attack in the debate of the HCJ was launched by Minister Naco during a meeting with the Spanish ambassador, where he expressed his concern about the assessment procedure of judges in Albania. HCJ concluded the declaration by underlining that the promotion of judges is based on the professional evaluation, different from the former experience, in which, according to the HCJ, the only things prevailing were the subjective considerations of the HCJ members.
