HCJ gives recommendations to Ministry of Justice, Administrative Court, a deposit of cases

The High Council of Justice recommended the Ministry of Justice to
appoint legal assistants for facing the flux of cases at the
Administrative Courts.

HCJ proposes to review the Administrative Court law and include a stimulating mechanism, so that citizens will not be forced to come to Tiarna only, but use other districts as well, since the Administrative Court has four vacancies.

Although the Administrative Courts were established for ending the delayed processes and answer to citizens within 90 days, the Hcj notes that the same thing is happening there.

The HCJ study says that in total for 2014, 55.000 cases have been submitted at these seven Courts. The HCJ says that the arguments have not been published within 30 days either, due to the flux of cases and the lack of legal assistants.

The HCJ says that the situation must be resolved. The HCJ advises increasing the number oif Courts at the Administrative Court of Appeal, who have had the biggest flux since the creation of the Administrative Court.

But the most interesting recommendation that focused on the legal amends is related to the fulfilling of the vacancies at the Courts of Gjirokaster, Korce, Vlore and Shkoder.

Although the competition for these Courts is open, judges have preferred to wait in case they are being appointed outside Tirana.

HCJ says that this recommendation is difficult to be implemented, since it requires a legal intervention for including encouraging elements, so that judges accept appointings in other cities as well.
