Former Property Return directors reported

The Agency of Property Return and Compensation (APRC) has filed a
criminal report against Avenir Peka, the former General Director of the
APRC; against Agim Toro, former Vice General Director; Ardian Spahia,
former Chief of the Legal and Assessment Sector; and Arben Cenalia,
former Chief for the Processing Sector, all accused of power abuse.

In the report sent to the Tirana Prosecution, the APRC says that the four suspects have violated a series of rules while performing their duties.

A number of violations have been identified by the inspection acts of the Working Group at the APRC, regarding returning to former owners property that is currently located within the territory of the Albanian National Guard. One of the most serious violation is related to the date of the issued processing decision:

The written date is earlier than the application made by the owners who claim the property. The document doesn’t have the stamp and the APRC admission protocol number. The investigation of the acts notes that the document has not been approved by the Interior Ministry. APRC says that in the final point of the  relation, the Working Group of the National Guard states that the National Guard territory is not used sportive purposes or landing of helicopters, but it never says they approve the former owners’ request, since the area can be used for other activities or even for a security perimeter. The decision for returning this property was made without this approval.

The Tirana Municipality has not agreed to return these properties neither, but, however, they were reserved in giving detailed information after the property inventory was completed. The Interior Ministry or the National Guard has never proposed to change the ownership of these properties. The report says that based on the identified violations, one can easily conclude that the Legal and Audit Sector has not made an objective and comprehensive assessment of the procedures that were followed by the Processing Sector for the Tirana District”. Other violations were noted during the inspection of the acts, related to the application process, the verification on terrain, the processing of acts by the working groups, the processing by the Legal and Audit Sector or by others.

The Prosecution is investigating the Chief Registrar of Vlore after a criminal report was filed by the Interior Minister, Saimir Tahiri, regarding a permit for the construction of the “Jon” apartment complex.
