From this month, nine Albanian cities will be left without courts and prosecutors as according to the judicial reform, and thousands of files for trial or investigation will be transferred to the institutions of neighboring cities, making the justice system more geographically distant for hundreds of thousands of citizens.
But even those who had cases in the court of their district do not escape the delays. Kadrie Lumshi complained on the investigative show Fiks Fare on Top Channel that she is not formally receiving the decision announced by the court.
She says that the court process closed 3 months ago, but the decision taken by the Court of First Instance of Durrës has not been formalized yet.
The issue is the guardianship of her paralyzed sister-in-law, since without receiving the forml paperwork, they cannot perform actions on behalf of her, since the sick woman is not capable.
She admits for Fiks Fare that the financial assistance of the disabled realtive is obtained through a notarial deed, while the guardianship is granted only by the court decision.
The complainant asks why the decision is not clarified even though it has been three months since it was taken, while the court secretary tells her that there were no judges to sign it.
According to the article 308 of the Albanian Code of Civil Procedure, the court decision must be signed by all members of the jury and must be submitted to the secretary no later than 20 days after the trial.
