Fatmir Limaj’s trial

If the Kosovo MP Fatmir Limaj will be investigated in free state or if
EULEX will take him under custody, it only depends by the Kosovo
Constitutional Court, expected to rule also about the immunity of many
other MPs and state officials.

This comes only because in this case there is still in act the arrest order against Limaj, released by the Eulex prosecutor.

Limaj’s lawyer, Tom Gashi explained for Top-Channel that if the Constitutional Court will rule that the immunity protects MPs for actions committed when they were not MPs yet, then he will be investigated in a free state. Otherwise, EULEX might execute the arrest order against him.

According to Limaj’s lawyer, against the client of whom EULEX has confirmed the accusation with suspicions of war crimes in the area called Kleçke, his client has been in Albania during the time that the crimes have taken place.

“Mr Limaj declared that during that time, he had been sent to Albania by the General Headquarters of the KLA, for preparing the operation ‘Arrow’”, Gashi declared.

Lawyer Gashi says that there is a list with 13 witnesses from the KLA General Headquarters who can testify, including Prime Minister Hashim Thaçi, Parliament Speaker Jakup Krasniqi and many others, who have been asked to testify in court about this.

EULEX has also confirmed that the accusation was also raised against nine other former KLA soldiers. The Constitutional Court is expected within September to say its word regarding not only the immunity of the MPs, but also of other officials, as requested by the government.

Limaj suing government

After the EULEX mission confirmed the war crime accusations against Fatmir Limaj, the latter declared that he is preparing a suit against the government of Kosovo and Prime Minister Hashim Thaçi.

Limaj argues this movement based on the fact that the Kosovo government requested the Constitutional Court to rule about the immunity of the MPs and other state officials.

According to Limaj, this action was anti-constitutional. He is quoted of having said:

 “Time will show this. I will do the same.”

Limaj warned that he will make public all the facts and names of the individuals that raised the two cases against him, the case of the Ministry of Transport and Telecommunication and the Klecka one.

This seems to be Limaj’s revenge, saying that he will spare no one.

According to him, this includes high rank international and local personalities, the names of whom will be revealed right after the trial will start. Declaring his conviction that justice will triumph, the former commander Çeliku declared that time will show that the war of KLA was right, and this case is nothing more than a fabrication for political interests.
