Court verdicts are often partial, contradictory and challengeable by
higher courts. According to the President of the Supreme Court, Xhezair
Zaganjori, the Albanian judiciary not only has corruption, but it also
wears out parties with long trials that take years.
Zaganjori declared during the National Judiciary Conference that the Supreme Court should not work under the pressure of voluminous cases, an issue that has been mentioned even by his predecessor. The Court is still reviewing cases of 2011, leaving parties to wait for more than two years. For this reason, Zaganjori made an appeal to the Parliament.
“I believe and hope that with the amends made to the Supreme Court law in the last year, we will be able to appoint two other judges in this court, bringing the total number to 19. Besides this, as we have agreed in principle, the law “For Administriative Courts” should pass in Parliament as soon as possible, because the treating of cases in the Counseling Room at the Administrative College of the Supreme Court has become a serious obstacle of our work, epecially for notifying the parties. Only for this reason, the College in question has been unable to treat hundreds of administrative cases for more than six months”, declared Xhezair Zaganjori, President of the Supreme Court.
The Minister of Justice, Nasip Naco, was more direct and declared that the judges cannot be appointed based on the mood of the High Council of Justice.
“In order to implement the reforms, I urge for the support of this conference in processing the ethics rules for the amends of the judiciary conference law, and for avoiding conflict of interest of the High Council of Justice members. I believe that you also consider it unacceptable that your elected at the HCJ exploit their mandate and trust by promoting themselves. It is also dishonest to use legal artifices to avoid the rule of law and allow conflict of interest between the HCJ members”, Naco declared.
For the President, the term “Justice Reform” should be used only to serve justice.
“I would applaud the reforms related to the creation of mechanisms that accelerate the argumentation of verdicts, and passing these cases to the judge. It is unjustifiable that today, six months after the Administrative Court became functional, the appointment process of councilors has been blocked already. I would maximally appreciate any reform regarding the orientation, specification and training of judges for some special groups, such as minors, who deserve a special treatment”, declared President Bujar Nishani.
