Electoral College: No code violation

Judge Tom Ndreca, head of the Electoral College that rejected part of
Socialist Party appeal against the procedure that the Central Election
Commission implemented for the result of Tirana mayoral race, declared
in an interview for Top Channel that the Electoral College is still
working on the argument that explains the Electoral College decision,
and that he doesn’t think that there is any violation of the code.

“Electoral College judges are still working on the argument that explains the decision taken on 3 June 2011. Currently, as you have heard, we cast lots for a new appeal that is going to be reviewed. This caused Electoral College judges to come from the other towns. The decision must be reviewed, signed and sent to the interested parties”, Ndreca declared.

But judges in other cities are not the only reason?

“No, this is not the only reason. The other reason is the short time in our disposal. The session was held this Friday, and the decision was announced at 21:00. Saturday and Sunday are holidays, and the deadline is three days. The reviewing process is ending, because each of us must justify its part. But the other judges were in their respective hometowns”, Ndreca declared.

Judge Ndreca said that the deadline for giving the argument is based on the Code of Civil Procedure.

“In my opinion, there is no violation. The Election Code provides a deadline of three days, but referring to the Code of the Civil Procedure, we say that we are within the time limit for giving the arguments that explain the decision. It takes time to make the arguments and to give it to the interested parties”, he added.

Regarding political pressures, Ndreca declared that he has not felt such a thing:

“I can speak only about myself. I have had no pressures of any kind. The Electoral College has given its maximal efforts on the case, trying to give a legal solution. The college decided to reject the appeal for ruling the act as invalid. We also rejected other interim decisions, which were considered as decisions related to the final decision”, Ndreca explains.

The Electoral College cast the lots for the next appeal of the Socialist Party, for the basic case of Tirana mayoral result. Head of this case will be Dhurata Haveri, and other members of the College are: Sashenka Jonuzi, Mari Qiriazi, Meriban Mullai and Astrit Kalaja.
