EC: Civil employee law must change

The European Commission declared that the government’s normative act for
the Civil Service Law, and considered it a technical solution while
waiting for the passing of the missing sub-legal acts.

“By what we have understood, the government undertook some measures yesterday to avoid a legal gap that would be created if the new law would enter in act unchanged. The amend taken yesterday is just technical and there is no case here. The importance of this law remains the same, and it will be effective after the sub-legal acts will enter in act. This technical problem was resolved by yesterdays’ technical decision of this government”, declared Peter Stano, Spokesperson of the Commissioner for Enlargement, Stefan Fule.

The Commission welcomes the usage of the law established in 1999 for avoiding the legal gap in those parts of the law thata re expected to change. As for the consensus that is needed for the other amends, the European Commission says that they expect a calm process, since the changes are simply technical.

The new government stood up to their decision for postponing the Civil Service law. This law was discussed in the government meeting, and it was on top of the list which has 33 decisions produced by the new Council of Ministers.

Through a normative act, the government decided to change laws 70 and 72. The normative act makes this law enter in effect on October 1st 2013, as announced, but its effect will start six months after this date. This means that for the next six months the government will still use the law of 1999.

This normative act is explained by the government with the argument that: “this was done by keeping in consideration the provisions of law 1522013 for the Civil Employee; the inability to implement it due to the lack of sub-legal acts and the insufficient time to make the first legal regulations according to the legislative process; due to the need for an institutional organization, the financial effects on the budget and the financial situation”.
