Dvorani’s mandate, Constitutional Court removed him, new Constitution keeps him in duty

Today’s session against MP Armando Prenga, charged with injuring and
threatening several people, has been postponed. Prenga was absent, his
lawyer was absent, but the unusual part was that Judge Ardian Dvorani
was also absent.

Top Channel has learned that this is not the only trial in which Judge Dvorani has been absnet. Since September 15th, when the Supreme Court started operating after the summer season, Ardian Dvorani has been absent from every trial.

The issue is more complicated than usual, because it creates a conflicts between a verdict of the Constitutional Court with the new Constitution. By the end of June, the Constitutional Court declared as anticonstitutional the law that allowed a member of the Supreme Court to stay in duty after his mandate was over, until he was replaced.

The request was made by the DP, who said that Ardian Dvorani was staying in duty even two years after his 9-year-mandate was over.

According to democrats, the majority rejected all presidential decrees for leaving Dvorani in duty, but the Constitutional Court verdict did not enter in effect until August 12th, when it was published at the official bulletin, two days after the new Constitution entered in effect, which allows Dvorani to stay in power until he is replaced. For this conflict, he was absent in today’s court.
