The Democratic Party appealed another law of the Government’s
Anti-Corruption package at the Constitutional Court. This appeal was
made against the establishing of the Bureau of Investigation, a
structure of the Interior Ministry that will deal with corruption.
For the Democratic Party, this structure is clearly anti-constitutional, because it transfers to the government the competences of the Prosecution.
“This structure takes the competences of the State Prosecution. This is how it is conceived and organized. This is a serious hit in the heart of the democratic system, because it violates the basic constitutional principles related to human rights and freedoms; related to the division and balance of powers; related to the exclusivity of the Prosecution to conduct investigations in this country”, dclared the Democratic MP, Arben Ristani.
The Chief of the Investigative Bureau would be the Interior Minister. According to the Democratic Party, this direct independence from the government makes the structure not only anti-constitutional, but also a political instrument that will give hits based on the Prime Minister’s will, not based on the law. The opposition hopes that the Court will consider the chapter of the Bureau of Investigation as anti-constitutional.
