The Democratic Party continued the accusations for the replacement of
employees in the administration. The Democratic Party Parliament Member,
Oerd Bylykbashi, accused the Rama government of infringing even their
anti-constitutional act by appointing militants.
“Everyone knows that the Constitutional Court has rejected the normative act through which the Rama-Meta government postponed the new law for the civil employee to April 1st, 2014.
But the government is still replacing employees through illegal recruitments from their militant base, based on this normative act. I want to remind to this government that from January 1st 2014, even according to the normative act, every recruitment based on the old law is forbidden”, Bylykbashi declared.
“Article 68.1 of the law states that no new procedure for filling a vacancy can start three months before the date when this law enters in effect.
According to the anti-constitutional normative act, the new law enters in effect on April 2014, and three months before April 1st, which is January 1st, no new recruitment can be done based on the old law.
The trick that this government is doing by violating the Constitution, starting from January 1st 2014, does not work anymore. Every vacancy can now be filled only with the procedures of the new civil employee law”, he declared.
According to the Democratic Party, every new hiring after January 1st is illegal and produces no legal effect.
“We want to explain to the employees fired after October 1st 2013, that these firings will be declared invalid as soon as the Constitutional Court brings its decision.
As result of this, every firing after January 1st creates an illegal vacancy and no one can fill that place”, Bylykbashi declared.
