The Democratic Party has turned to reality the public reports made in
the past weeks for two government decisions, the normative act for
changing the state budget, and the decision that gives new competences
to the National Inspectorate of Urban Construction.
The Democratic Party has challenged both these decisions at the Constitutional Court, asking this institution to repeal them as anti-Constitutional. In each of the complaints, the Democrats have given their legal arguments, saying that the decision for the National Inspectorate of Urban Construction competences was anti-constitutional, because it damages at least five constitutional principles that do not recognize the right to property and give governments the competences of the local and judiciary powers.
By listing the new competences that allow National Inspectorate of Urban Construction to demolish any illegal construction without letting owners appeal the decision, or when their permit appears to be illegal. The Democratic Party wants the Constitutional Court to suspend the government’s decision until the case is reviewed, for a decision that the opposition wants to be repealed.
The Democratic Party values as anticonstitutional even the normative act that changed the budget 1 month ago. It increased with 68.6% of the public debt, and according to the Democrats, this damages the public interest. The Democratic Party says that they are protecting the public interest by asking the repeal of the normative act. According to the opposition, the public interest in the case in question is endangered due to the government’s irresponsibility by increasing the public debt, which according to the Democratic Party puts in danger the macro-economic stability of the country by bringing Albania to an economic recession. This is the third lawsuit that the Democratic Party is filing at the Constitutional Court, since the creation of the new government two months and a half ago.
