Xhemal Hasalami was fired in 2007 from the Aqueduct Enterprise of the
Kamez Municipality, and right after that he addressed to the court for
seeking justice.
Although the court decided in 2008 in favor of Hasalami, the court decision has not been implemented even after six years.
“The court decided that I should be paid with 180.000 ALL or six months of salary. They are not doing it. I don’t know why verdicts are given when they are not implemented. They say that they will pay it until 2019”, Xhemal Hasalami declared.
The Commissioner Assistant at the Ombudsman, Arben Gjoleka, has 81 other similar requests. While the Ombudsman has asked the Ministry of Finances and the Ministry of Justice to react, the authorities have remained silent.
In these conditions, the Ombudsman addressed to the Constitutional Court for repealing an order of the Council of Ministers, which enables delays in the compensation payment.
“The problem is that when citizens win a case at court, the bailiff is avoided and the citizens take the payment in installments or they have it delayed”, declared the Commissioner of the Ombudsman, Arben Gjoleka.
There are dozens of similar cases at the court, and they rarely and in time. The Ombudsman says that they have requests since 2003 and the law on this point is not correct. This request of the ombudsman will be reviewed by the Constitutional
