Decriminalization, MPs file complaint at Administrative Court

The Tirana Administrative Court of First Instance will be the first
legal arena where the two former Parliament Members will demand back the
mandate removed by the Central Election Commission.

Genc Cifliku, lawyer of former MP Shkelqim Selami, asked for a repeal of the administrative act dated December 29th, announced by the CEC. His second request was that the judge panel should suspend the CEC decision until the trial is over.

Former Democratic Party MP, Dashamir Tahiri, requested the same thing. His lawyer, Fatmir Braka, was contacted by Top Channel, and said that his client’s mandate was removed after a document coming from Europol, but without a court verdict from the Italian Justice.

Top Channel contacted with the former Mayor of Kavaja, Elvis Rroshi. His lawyer, Theodhori Sollaku, said that within the 15-day deadline, he will file a complaint against his client’s suspension, by attacking this way the government act but also specific elements of the decriminalization law.

All three politicians were removed by the decriminalization law, since they resulted convicted in Italy, which they had not declared in the application. By request of the CEC, the Prosecution General made all verifications and removed their mandates.
