“Decriminalization Law” to be challenged in Constitutional Court by Rroshi’s lawyer

30/12/2016 00:00

After the Central Election Commission removed the mandate of the Kavaja
Mayor, Elvis Rroshi, and Parliament Members Dashamir Tahiri and Shkelqim
Cani, Rroshi’s lawyer announced that he will file a complaint against
the CEC decision at the Constitutional Court.

Many politicians and law experts have declared so far that this law is among the harshest in the world, and there could be a chance that the Constitutional Court might reject it.

The situation seems more complicated for MP Dashamir Tahiri and Shkelqim Selami, who are still unclear about where they will deposit their request, to the Central Election Commission, as the Electoral Code provides, or to the Administrative Court, since the CEC decision is considered an administrative act.

Despite the legal conflicts, PM Rama signed this Thursday the termination of Rroshi’s mandate, which will be sent to President Bujar Nishani.
