The Court of Appeal rejected the lawsuit of the former Minister of
Culture, Ylli Pango, who asked a 1 million EUR compensation by Top
Channel, claiming that his privacy was violated by the video-scandal
published by Top Channel’s investigative program “Fiks Fare”.
The Judges of Appeal, Metush Saraci, Gjin Gjoni and Hysni Demiraj said that the verdict of the Court of First Instance will remain in power. This verdict had also rejected Pango’s lawsuit and his request for 400.000 Euros which had been approved four years ago by Judge Agim Bendo.
The Court’s verdict answers to the six year-long trial, after the scandal in which Pango is seen asking sexual favors from a girl who was looking for a job.
Bendo ruled in favor of Pango in 2010, fining Top Channel with 400.000 EUR, but the Court of Appeal and the Supreme Court repealed Bendo’s verdict.
For this reason, the Court of First Instance reviewed the case and nullified Bendo’s 400.000 EUR fine.
The Court of Appeal based its decsion on the practice of the Strasbourg Court, which has given other decision in which they make a difference between the privacy of a public official and an individual, and with Pango’s case, the public has the right to be informed.
Top Channel
