Constitutional Court rejects NIshani

The Constitutional Court has rejected the request of the Albanian
President who complained against the Parliament’s decision to discharge
the Chief Inspector of the High Inspectorate of Declaration and Audit of
Assets, and replace her with Shkelqim Ganaj.

The Constitutional Court notes that the President claims to resolve the conflict of competences, while the Parliament has declared that the voting for discharging Mrs.Xhuka aimed to resolve a bad situation. The Court says that after reviewing the case, the majority of the judges in the panel voted against the claims of the President.

The Constitutional court says that since the case did not receive the majority of votes, the request will be rejected.

Article 74 of the law says that when the request has been rejected because the absence of the necessary quorum, the request can be repeated again if the conditions are right for forming the necessary majority.
