Constitutional Court rejects DP’s request for suspending new Territorial Division

The Democratic Party claimed that the territorial reform has violated at
least five constitutional principles. Oerd Bylykbashi from the DP
declared that the reform was approved in only three months, which the DP
finds as insufficient, For Bylikbashi, this has only damaged what the
Constitutional Court has requested, that of having a reform that goes
beyond one majority.

Judge Vladimir Kristo: What is your contribution in this reform? Albanians have it easier to criticize than contribute.

Oerd Bylykbashi: We should be sitting together and it should be guaranteed that it wouldn’t change in a plenary session.

The Democratic Party says that besides the accelerated procedure, the majority has not consulted it with citizens. The government responded by saying that they have met with citizens and asked for their opinion, but not their consent in a national reform.

Another argument of the opposition was that the criteria were not respected equally for every unit. For this argument, Oerd Bylykbashi from the opposition mentioned Divjaka, which is not a local unit of its own, but Velipoja that had the same conditions did not undergo the same procedures. Armand Subashi responded by saying that if it was certain that one specific area always votes for one specific party, then elections wouldn’t be necessary.

As for the opposition’s claim that the territorial reform was not followed by other amends in the law for the local government and at the Electoral Code, the majority declared that they deposited the amends in Parliament for the former, and invited the opposition to be part of the amends for the latter, since there is still time to cooperate before the local elections.

The Constitutional Court withdrew for taking a decision, and before starting this session they rejected another request of the DP, that of suspending the law. They left it in power until a further decision is taken.
