Constitution amend for judiciary reform

The Albanian Minister of Justice declared in a meeting for the judiciary
reform that the government will be forced to amend the Constitution.

“This process will be done in cooperation with the Commission of Venice. It will have the consensus of the respective justice leaders and politicians from the opposition, who must be more active. Not only for the votes that the Constitutional amends require, but also for guaranteeing a stable and constant reform through the years”, Naco declared.

The opposition ended the dilemma for being part of this meeting, by bringing a lower representative who confirmed that the DP will be part of the process, but with two tasks.

“We will be part of every meeting. We will contribute with our vision and our perspective every time there will be a draft law. We will report the deformation of principles that should lead the justice system”, said the Adviser of the Democratic Party Parliamentary Group for Legal Matters, Gazmend Bardhi.

The Chairman of the Parliamentary Commission for Laws, Fatmir Xhafa, gave concrete details about how the reform will be done. He announced the establishing of a parliamentary structure and its constitutional principle.

“We offer consensus for the reform. We offer time and space for everyone, for the opposition and all participants of this system, and also for the international assistance. We trust our experts and we will express this by leaving the reform and drafting of the laws to be part of it, not in the hand of politics. We will leave it on the hands of the best experts of the judiciary system and of the international assistance. Together we can finalize a reform that will last in time”, Xhafa declared.

The guarantee from the Chairman of the Commission of Laws that politics will stay far from the reform process and that it will be assisted by international experts, from the Commission of Venice first, fulfills one condition of the opposition and also one request of the President, who was represented by an adviser.

While the political parties exchanged messages, the US Ambassador, Alexander Arvizu, reminded them that the judiciary reform is a condition for opening the negotiations for EU membership.

“The Albanian and international communities expct this reform to cure the problems of this system, not only for reaching some political goals or for changing the personnel in these institutions. This is the time to establish trust and progress in a more mature, inclusive and non-political process. It is important for the majority to establish the right tone, by approaching to all groups of interest, including the political opposition in a sincere way. As regards the opposition, it should keep rhetoric under control and should be less confrontational”, the US Ambassador declared.

The Ambassador listed six points that he said are advice from a friend country of Albania.
