Civil Employee law changes

After the Constitutional Court repealed the Normative Act of the
Albanian Government for the Civil Employee law, the majority has sent a
draft law for discussion at the Parliament.

Two of the more important articles of the draft-law are related to pressures for the workplace and indemnities that are planned to be with 1 to 3 monthly salaries. This is what article 50 of the law foresees.

“The responsible unit notifies the Civil Employee one month before the initiation of the procedure for the closure of the institution. In this case, if there are no chances of transfer, based on article 2, the employee is let go with the salary of one month for civil employees who have been working for one year, two months for those who have been working up to five years, and three months for those who have more than five years of experience”.

“The same procedure will be used for initiations of the institution restructure procedure. A detailed procedure is needed for rearranging the civil employees when one institution is closed or is being restructured, and a detailed composition of the commission is approved by the Council of Ministers”, the draft law says.

DP: Government violated constitution

The Democratic Party reacted against the draft law approved by the government. Parliament Member Eduard Halimi declared that this action is not transparent and falls against the Constitution.

“The Democratic Party denounces this as an unprecedented act in the history of Albanian and world legislations. A law has been completely undone, completely changed, without being implemented for a single day by the government. For this law we had meetings with public experts and the media for two years. 16 articles changed overnight. Edi Rama has made it clear that he is against the political consensus and has chosen to burn any chance of dialogue with the opposition”, Halimi declared.

Parliament Member Halimi listed three things that according to him the government is trying to achieve will these amends.

“This draft law of Rama deteriorates guarantees for staying on duty not only regarding the existing law for the civil employee, but also regarding the former law. It legalizes all decisions to fire people against the law and all firings that have taken place so far”, Halimi underlined.

According to the opposition, the government’s draft law is undermining the consensus with which the Civil Law has been approved.
